Default Collection for Unwanted DSL Service after Five Years
My junior year in college my roommate ordered DSL for our apartment while using my phone line. The next day when his separate line was activated he called to ask when the package would arrive, they had no record of it, and so he ordered DSL again. Turns out both his orders went through, but one was on my line in my name even though I never said a word or signed anything. DSL at that time only came from PacBell in one year contracts.

Fast forward five years, and at leat two collection agencies. I refused to pay it all along, even though my credit has been severely damaged. Otherwise I have very good credit. At one point about a year ago after telling the collection guy not to call me anymore, he told me that if I had read the back of my agreement I would have seen that he was authorized to collect from me. I advised him that if he had read the front, he would not seen my signature. I proceeded to tell him that I would never pay and that I would love to go to court about this. I did not hear from them for a while.

About 3 months ago I finally got a court order sent to my parent’s house. My mom said I had a court date mid December 2005. The letter was lost so I never actually read it. When I called to make sure of the date and time, the court lady told me that I had had a default judgment against me for not responding within a certain amount of days.

I had a lot going on at the time around the time the letter came, I moved from San Diego, to the Central Coast, then from my mothers house to my fathers then within a few days of moving I had reconstructive knee surgery back in San Deigo from which I am still unable to walk without crutches.

All my attempts to find out more information have failed when I haved called the court askign about the apeals. I wonder, is there a way to appeal this and have the case reopened? I am still a half month away from my originally stated court date.

Default Default Judgment
You should consult a lawyer in the state and county where the default judgment was entered, about the possibility of bringing a motion to have the default judgment set aside.
