Crossing Double Yellow In California, With Errors On Ticket

I was cited for crossing the double yellow, no violations on carpool, since I had a friend.

Cop hiding behind a broken center concrete divider pulls me over my miata and 2 other SUVs. He says he saw me cross into the carpool lane over the double yellow. Only thing, I was already in the carpool lane.

My ticket shows that I have a green car, and that my Driver's License is from CA. My car is blue and I have an Arizona State License.

I've already plead not guilty, trial is set in 4 weeks.

Any Advice is appreciated.

Go to court and fight it.

I would not raise the driver's license issue. If you do, odds are they'll correct it and if you're convicted of the violation it will be abstracted back to Arizona.

Ooooh, that's a tough one. I see Mr. KIA's point. On the other hand, if the officer's powers of observation are called into question by pointing out TWO errors instead of just one, along with your passenger's testimony (if you can get them to come to the hearing) that you were, indeed, in the carpool lane, that should be enough to create "reasonable" doubt.

But, if, as Mr. KIA points out, you STILL lose, it will most assuredly be reported back to AZ. Hmmmm. As I said, "tough one".

"The car was green" or "the car was blue" can be a matter of opinion. Some colors are somewhat ambiguous, and some cars look different depending on the lighting. The judge is going to be most concerned with, "Was it you behind the wheel?"

Unfortunately my passenger was a cancer patient passed away a month after the ticket.

How do I win this case?

It comes down to my word or his and the assumption that how could he see a car if he cant read a license inches from his face. I refuse to pay for something I didn't do. Some cop charges me with something and I have to pay $400 to the court? I served as a military officer for years and so HELL NO I will not let this happen.
