Default Cosigner Is On Car Title And Is Making Payment, But Her Friend Isn't
My question involves a consumer law issue in the State of: Texas

My young foolish daughter cosigned a car loan for a "friend" of hers whose dad had destroyed the young man's credit. She actually is the main person on the loan and he is the cosignor; both are on the title. He got sick and missed a few payments and didn't tell her. We found out through the loan company. She caught it up and has been making him pay her so that the payments are on time. He still hasn't caught up entirely but did not pay anything this month at all and is avoiding all calls. She has been trying to get him to refinance all this time also. By law, can she show up with her key and drive the car off to her house? Or does she have to hire a lawyer, go to court, and get the car and then sue him for court courts, etc.? I think if she physically had the car, it might push him to refinance, but she doesn't want to get pulled over and arrested.

exactly how is the car titlled?

Chances are, she can repo the car (not actually repo since the loan is hers and the car is titled in her name at least in some fashion) but the exact listing on the title would help to be sure.

Whose name is the car registered under?

It is titled in her name and his name so that is why I thought she should be able to drive it home without a problem, but you never know.
