Paying child support for someone else's kid
Hi again, I have a friend who has been paying child support on his son who is 3 yrs old now, and he has paid throughout all those years. Him and the mother were married at the time but then divorced shortly after. His name is on the bc and the child also has his last name. However there are questions now if the child is really his. Stories are coming around that she cheated at that time and she sends him emails now taunting him that he is paying child support on a kid that is not even his. (he has kept these emails for proof) My question to you is, what would be the steps of getting this resolved? Paternity test obviously is the first step, but does she have to consent to it? If so how can he get it court ordered? Also, if the child is not, how can he get any child support re-embursed? Does the fact that they were married at time of birth matter in any of this? Any explanation of what the judge might do in a case like this, would be helpful. Thank you.
