Evicting a Non-Paying Roommate

became room mates about 6 months ago, 2 and a half months ago we got a new house. 600.00 deposit, 600.00 rent. it is now from move in date oct-dec 1 2005. the total incurred bill stands at 2617.00. one room mate has paid 1000.00 and the other has paid 360.00. he has been asked and told to move out 4 times now. he says okay but refuses to actually kleave the residence. the land lord is willing to work with the paying room mate. how can i legally get him out. freeloader!

You can sue him in small claims court. Unfortunately, he is your landlord's tenant, not your tenant, which limits your legal remedies.

If he is your subtenant and isn't paying, you can follow the laws of your state for eviction - service of a notice to quit for nonpayment of rent - and if he doesn't pay the rent can proceed with an eviction. You should also be able to terminate his tenancy on one month's notice, as a month-to-month tenant. (There are probably standard forms for giving him notice, which you may be able to obtain from your local courthouse.)
