    Default Ex Is Filing For Divorce After Eight Years

    My question involves child support in the State of: tn
    my ex-wife upon our seperation tld me she did not want support just for me to dissapear there was no parenting plan in the divorce. Now 8 years later she has resurfaced and filed for support as well as back support.
    can she do this since she willfully kept the children from me.

    How did she willfully keep them from you. She asked you to disappear you could have disagreed.

    They're your kids, so as long as they are young enough to qualify for support, your ex-spouse can seek support.

    she asked me to dissapear yes thats true but she is the one who did the dissapearing act at that time in my life i had no means to fight for the kids. i dont have a problem paying the suppourt if i can see my kids. i just dont see how she could ask for back suppourt when she left our home in ohio without my knowledge and moved to ky isnt that against the law itself? then was living with a man while we were still married then when i moved to ky to be near the kids she vanished. the divorce was settled and in the divorce she made no request for child suppourt

    Every court in the United States has a method for the indigent to get into court for free and legal assistance that is available. I don't buy that for a second.

    Child support is not an admission ticket. You will pay it whether you see your kids or not. You don't buy your children, they have the right to be supported by you.

    You did nothing about it and if you knew she was in KY, then she didn't disappear.

    Well, back then the issue of support wasn't discussed, now she would like to discuss it, as is her right. Can she get back child support? For 8 years, probably not. For some period, maybe.
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.

    The good news is that now that you know exactly where she is and how she can be reached by the Court - you can file for visitation in order to enjoy the PRIVILEGE of your children's company. As their father it is your right to see them. You may be required to have supervised visits until they become reacquainted with you.
