    Default Not Prosecuted?

    My question involves criminal law for the state of: california

    I was caught stealing on april 1st and was asked to sign a civil demand. no police was involved and i was told that i will receive a civil recovery "fee" within 3 weeks. its may now and i have not received anything. i called the LP department and they told me that they are not the one to decide to prosecute me nor it was the legal department in michigan ( they did not have me on the system and told me it usually only takes a month for the files to be updated on their system and thought it be better if i contact the LP office) . LP officer thinks its the corporate whos going to decide if my case will be sent to the legal office.

    Item i stole was a 20 dollar earrings and was able to recover to its condition right away. Is there a chance that they will not prosecute me? meaning i wont hear about them regarding the civil demand?

    Sure there is a chance....

    However, these things can take months. The statute of limitations for most misdemeanors is one year.

    statute of limitations for misdemeanors in one year?? you mean it can take up to 1 year for the company to decide to either to charge me with civil penalty? police was not involved so i wont be criminally charged ??? or does that also take up to 1 year?

    The SOL I am referring to is for criminal prosecution. If they choose to go that route.

    If you do some research in the forum you will find where some people didn't get the civil demand letter for several months.

    If your worried Civil Demand went to wrong address or anything similar contact the store and ask for numbe rof thier Civil Recovery service

    they didnt receive anything for several months?? then was charged with criminal charges after all thoes days?? can they do that??? i mean.. the police was not involved and no police contacts so far... it was only 20 dollar item.. not that it was okay to just steal it.. but is it really worth trying to prosecute me possibly sue me and loose money for??

    If the store decide to press charges within SOL they can. All they do is send file to DA and request prosecution
