Default Signed For Car For Family Member, Now Repossessed
My question involves an auto loan or repossession in the State of: Utah.
My husband got a truck for his brother because my brother-in-law's credit was bad. My brother-in-law immediately took possession of the truck and has had it ever since. He's been making the payments except after being late a couple of times a few months ago he was finally too late and the truck got repossessed. Now we are stuck with a balance of about $13,000. What can we do to make my brother-in-law pay for his debt? His name is not anywhere on the title, just my husband's.

P.S. Currently my husband is out of status in this country. We're working on getting him back in status but it would take some time. Is that relevant if he sues his brother?

He does. He lives far better than we do and owns a home (which we don't). Within the next week we'll settle with the bank and see how much we actually need to pay and what payments we'll be making. After the balance is paid can we sue him for it? My husband's credit is already ruined. I want to at least make him pay that balance.
