    Question Juvenile In Possession Of Drug Paraphernalia

    My question involves criminal law for the state of: Iowa

    I am 16 and a licensed driver, my story is as follows.

    I was on my way to a friends house to spend the night and had asked a friend to give me a ride due to me not having a car. He was pulled over for speeding in front of my friend's house, and the officer had asked to search the car, my friend refused it and I had a pipe in the car. After a few minutes of discussion, my friend returned with a speeding ticket in hand, the canine unit pulled up as he was getting into the car. As he was shutting the door, the officer that had just showed up told him to step out of the car. He did. After exchanging a few words, the officer then came to my side and asked me to step out. I did. He proceeded to ask me a few a questions. Then brought his canine around the car, the dog scratched at the door and the officer began searching the car. He found the pipe in a camera case and I told them it was mine, and was arrested.

    I'm wondering if everything the officers did was legal (most notably bringing in the canine after the speeding ticket was issued) and what consequences I will most likely be facing besides the fine of $50-500 dollars.

    I have also moved to a different state since the incident and am curious has to how that will affect this?

    You're also looking at the possibility of up to 30 days in jail.

    The fact that you have moved does not relieve you of your obligation to show up for court and take your lumps.

    Officers have a nose that is nearly as keen as a canine. If he thought he smelled something or noticed an indicator (eyes or shakiness) then he has the right to call a unit. As soon as the K-9 officer shows a trigger (door scratch, sits down and stares), the officer has a right to search.

    If your friend had driven off legally then there might be room to have it thrown out.

    Work with an attorney (public defender is good) to see if they can get you a defermed ajudication based upon successful completion of an anti-drug program.

    ...and quit smoking weed! I know, it's rare when weed is smoked in a pipe; usually it's a bong or bat or rolled. If you are smoking ice or crack, your life might have recieved the interdicted it needed.
