    Default Defamation Of Character By A Radio Show

    My question involves defamation in the state of: California

    Yesterday morning I called into a Radio Station which I will not name for a contest. The DJ asked where I worked etc as they normally do. At tail end of the call which I heard played back on the radio the DJ said for me to go and take my Ritalin which I do not take. There were many people who heard this comment. I called the program director and he concurred with me that the DJ's partner and him thought it was a rude remark and they admitted to doing it. I e-mailed the DJ telling him how upset I was.

    I am sure other people that knew me from work heard this remark too.

    Would this be a case of Defamation of Character? My feelings were hurt and the DJ made it sound like I have a disability which I don't have. My voice comes out the way it does and no one has ever made such a remark.

    Would this also be slander. Can I get him for pain and suffering since a lot of people heard this on air. I was very professional on the air and I only caught this remark when the call was played back. I am sure he added this when I hanged up as I did not hear it on the call. If I heard it I would have said for them never to put the call and to restart the call with this information left out.

    I have never heard such a remark made on the radio. I do not know how I can go to work with this comment. Even if the DJ thought it was a joke I took it personally and I would never make such a joke to anyone.

    Can I go to my college tomorrow and file a Police Report since the DJ put on the part about where I worked as they normally do for this contest. Should I report this to the HR Department etc? A lot fo my friends and co-workers like the station and I am sure they heard it. My reputation has been hurt due to this. You can be sure I would have never called had I known the DJ would say this. I was excited to be the winner in a contest as this was my second time and I have always tried to get through. Other people were more excited than me and they never had such a comment said.

    How much should I ask for if this is a legit case. Any lawyers in the Bay Area who you know would do this on a contingency basis?

    This sounds like your "bottomless cup" and "celebrity relative" questions; an interesting question, but something I suspect that you're making up. No, you don't get a viable defamation case against a member of a radio station's morning crew because they make what is obviously a joke about you on the air.
