    Unhappy Written Month-to-Month Tenancy

My question involves a roommate in the State of: California

My name is on the lease. I have a written month-to-month agreement with my roommate -who's not on the lease.

Problem: She's only been here a few days (paid the monh's rent and deposit), but it's not working out. I'm more than willing to return her deposit after she moves out.

What other legal responsibilities do I have if I serve her with a 30-day notice even though she hasn't lived there 30 days?

BTW, her background check came back with 35 known addresses, 5 aliases, and 1 criminal conviction. Never again!

Holy cats! Next time: background check first!

Beyond the thirty day notice and refunding her security deposit in a timely fashion, there's nothing else you need to do.

Unless she refuses to leave, in which case you'll have to initiate formal eviction proceedings.

Ok you have a lease but rent a room to another on month to month terms? Is your Landlord aware of your renting space in his/her dwelling? Anyhow this site may help you with how to remove the unwanted roomate/tenant

    Hi-

    Thank you for responding.

Yes, both the property management and the owners know that I have a roommate. And the site is very helpful. Thank you!

I am considering getting a roommate. I have a spare room. My name only is on the lease. What steps should I take to protect myself legally?
