    Angry Grandmother Wants Visitation Rights

    I live in North Dakota. I have a son who is currently 2 months old and I'm raising him with the baby's father in our own apartment. Recently my mother has been acting irrational and unfair. She is very upset that I choose to live with my baby's father instead of her & is now very jealous of him. She harrasses us and comes up with things like how he is not the father and how he is controlling me and trying to keep my son away from her. She has no reason to believe that he is not the father and she has no reason to believe that he's controlling, they got along great until I decided to live here. Now she's constantly coming over and calling and harassing my boyfriend, she even went and talked to a lawyer about court ordering a blood test for my boyfriend and my son, which is completely irrational and there's no reason for her to do this. I'm so fed up with her that I told her she can not see my son until she learns to accept my boyfriend and stops harassing us, I then got a phone call yesterday morning and she told me that she's taking me to court for visitation rights. I live in North Dakota, can she do this? I really don't want her seeing my son, her presence makes me very uncomfortable! I told her to stop calling, and to stop coming over but she won't stop bothering me. This is so stressful.

    Sure, she can take you to court, but that doesn't really mean anything but that she can take you to court.

    "I'm gonna sue!" is not remotely the same as "I won in court!"

    14-09-05.1. Grandparental rights of visitation to unmarried minors -Mediation or arbitration.

    The grandparents and great-grandparents of an unmarried minor may be granted reasonable visitation rights to the minor by the district court upon finding that visitation would be in the best interests of the minor and would not interfere with the parent-child relationship. The court shall consider the amount of personal contact that has occurred between the grandparents or great-grandparents and the minor and the minor's parents.

    She's going to have a hard time proving in court that visitation with her is in the best interests of a 2 month old.

    Hold your ground and let her bluster. If she goes through with it and sues, hire an attorney and continue to hold your ground. The rights all lie with you, not her, and it's up to her to prove that the child will suffer without a relationship with her.
