    Default MIP In Washington

    My question involves criminal law for the state of: Washington

    I'm 19.

    I was at a party where I and a friend had consumed alcohol. I know I had waited at least 3 hours before getting into my car and taking my drunk friend home.

    I was initially pulled over because I had a break light out... the officer asked to see my license and registration and I gave those to him. He then asked if I had anything to drink. I said yes.

    I don't like to lie and especially to authority and my friend was in the back seat. As far as I know it's a cops job to ask questions and he probably would have found out eventually. I did take a field sobriety test and a a breathalizer. I don't know what I blew however and it's not written on my ticket.... I don't know if it should be or not. I wasn't drunk and did not feel any affects of alcohol on my body at the time; I felt normal.

    I was not givin a DUI but and MIP.

    I have my first court date on May 6th... I forgot what its called... but I'm not sure exactly what I should do... I wish to get this done and over with as soon as possible... and what kind of sentences am I looking at...

    This is my first criminal offense... I did however recieve a speeding ticket prior to this... in September... Which I paid in full.

    What will the court room be like? Will I get to discuss the situation and will I know my sentence before pleading guilty or not guilty?

    Is it possible for me to get this taken off my record?

    Any answers will really be appreciated. I'm trying to find out exactly what I got into. Thank you.

    Quote Quoting Washington State laws regarding minor in possession (MIP) and use:
    • Persons under the age of 21 may not acquire, possess, or consume alcohol. Nor may other persons furnish alcohol to anyone under 21 or permit underaged consumption on premises within their control. Penalty: Maximum $500 fine, 2 months imprisonment, or both.
    • Persons under 21 may not be in a public place or in a vehicle in public while exhibiting the effects of having consumed alcohol. A public place includes city streets and any buildings and grounds used for University purposes. Penalty: Maximum $500 fine, 2 months imprisonment, or both.
    • Persons under 21 may not purchase or attempt to purchase alcohol. Penalty: Maximum $1,000 fine, 90 days imprisonment or both.
    • Alcohol may not be opened or consumed in a public place. Penalty: Maximum $1,000 fine.
    • It is unlawful to manufacture, deliver, or possess an illicit drug. Penalty: Maximum $10,000 fine, 5 years imprisonment, or both. The possession of 40 grams or less of marijuana is a misdemeanor (minimum $250 fine and not less than 24 hours in jail).
    • It is unlawful to possess or use drug paraphernalia for purposes relating to the manufacture, delivery, possession, or use of an illicit drug. Penalty: Minimum $250 fine and not less then 24 hours in jail.

    He confessed to having consumed alcohol, and the officer has a PBT with an unknown alcohol reading, quite possibly positive. And this thread is from 2008.

    hey i just got a ticket im not sure what it is. i was walking down a street and 2 officers came and breathalized me i blew a .242 then they took me to my dorm, i live in washington the ticket says i was showing the affects of having consumed alcohol do you know how much it will cost me
