Default Getting Tickets For Car Not In My Possession
My question involves an auto loan or repossession in the State of: Texas. We sold a vehicle in 2006 and along with that, it was in the contract that the buyer register the vehicle in his name within 30 days. This has not happened and here it is 2 years later. I have talked to him and he says he gave the car away. Well the major problem is that we too are getting tickets for toll road violations, and parking tickets as well, the vehicle is still in our name and we keep getting the tickets. One police officer told us it is not illegal for us to retrieve the vehicle as the original contract was breached. But if you can provide directions etc. its most appreciated. Because we are liable here if the guy gets into an accident because according to what we were told we are the ones that are supposed to have it insured, hence its in our name ADVICE ANYBODY

Talk to the Texas DMV.

This problem comes up all the time; there are solutions in some states.

I did talk to the DMV, The Harris County Sheriffs Office,The City of Houston Municipal courts, Harris County Contstables office. Pretty much one told us to report the truck stolen as the contract was breached,another told us to sue in small claims..hence the problem is we can't find ther person(s) and they have moved from the residence at the time of transaction. The title is still in our name, we were instructed by another to get the vehicle registered, insured prior to reporting it stolen. I just wish I could get the same answer twice!! I do not wish to break any sort of law here but its possible that if we do take the vehicle the person my decide to communcate with us and take care of all of these violations. We do know that the vehicle was stopped by HCSO on March 20th, but they told us until we could produce the title they couldn't release any information other than that. So we feel we are in limbo, waiting on the mail just to get our next round of tickets for the tollway. On a good note, the vehicle has not been impounded! But, thats questionable as well considering its not registered or inspected and I don't know how they could get insurance of any type on it because as I said its still in our name. It also shows up as an asset in our financial end as well. When you have 7 children and are attempting to obtain financial aid to put one through college, that too is an obstacle..Its the true domino effect. Another thing we have no idea if there are tickets on the vehicle in other counties or states for that matter. Please keep me informed if you think of any other remedies. Thanks Teri In Texas
