Default Paternity Fraud
I would like to know if there is a florida statue or Law that help with paternity fraud on children born within the marriage. My husband just found out that a child born within the marriage is not his, by the DNA test. He has been supporting this child for 8 + years. The mother abonded his children and he got custody of them, however, we think it is not fair to be raising a child that is not his. The mother wants them back, because she wants child support. He paid child support for several years and she found out that he got married to me she left them and he had to bring them home. Now she has custody of the child in question, does he still have to pay child support, what if he does the test in the other two and none of them are his, will it be fair for us to pay childsupport and not to spend that money in our child college education or else. Please help!

Default Disputing Paternity Years After-the-Fact
Your husband is probably precluded from disputing paternity, as he stipulated to his paternity in any consent judgment of divorce, or was otherwise adjudicated to be the father at the conclusion of the divorce trial. It may be possible to amend the judgment with the consent of the parties - consult a local family lawyer to determine what remedies you have, and how to avail yourself of them.
