    Default Unreasonable Landlord Vs. Innocent Tenant

    My question involves an eviction in the state of: Oklahoma
    I have a case that's been dragged on since the year of '04. The landlord filed a case on us (my parents). She claims that we damaged the property, had "extra" people living in the house, had pets, and damaged the carpets and other furnitures around the house like windows, and vent. We didn't leave much damage, most of them were normal wear and tear. Plus the a lot of others were messed up in the first place (she said she'll get it fixed after we moved in but she never did). When we moved out 2 months before the contract ends, she already filed a lawsuit on us. And blamed all the damages on us. Therefore our attorney told us not to pay the last 2 month since she kept our deposit. As a defendant we were told it's best not to push the case, the downside of that is. Recently our lawyer quit on us due to health problems. My landlord immediately called me to settle out of court but she's demanding an extraordinary large amount of money exceeding 10,000 while we still don't have a lawyer and she does. I'm still in the process of looking for an attorney. But my previously lawyer advice us not to meet with her at all because we will have a good case. Just the other day she called me again! what should I do before I have a change to find another lawyer?!

    **also.. what does "motion docket" mean? (sorry I'm not very familiar with the law terms)

    You should do precisely as your previously attorney instructed. Don't meet with her, don't talk to her. Take no action until you have retained counsel.

    The motion docket is simply a schedule.

    Courts typically have specific days when they hear motions. The list of cases they hear on any particular day is called the "docket". So the "motion docket" is a list of motions scheduled to be heard on a particular day.

    If a motion has been scheduled in your case, try to retain a new lawyer prior to the motion date or see if you can get the motion adjourned (postponed) to a later date.
