    Default Annulment Over Spouse's Misrepresentations

    TEXAS Am i able to get annulment after been married since 11/99 and he left in 12/99 because he told me he was legal but after we married he said he was not really legal that he was illegal and needed his papers i told him no i will not help you in that matter so am i entitle to annulment on the grounds of fraud because he only wanted his papers?

    Yes. Between the fact that he admitted that he only wanted his green card and that he left you a month after the wedding, you've got grounds to seek an annulment.

    Thanks alot but i dont have a clue where he is at can i still get it annulment done?we have nothen what so ever to gether.i dont know if he is still in the usa or not.i have the forms to file for it but just want to see before i file them and how long does it take to get it annulment even if its been so long of a time frame.

    But you've known of the fraud for nine years... sounds like you would need a divorce by publication to me...

    yes,thats true but he said he was going to get a divorce because i would not help him.but i thought after so many years apart you are no longer married.i felt he left he should file.that shows how sorry people can be in tring to get stuff through marriage.

    Hi i have a question again does he have to be in the court for annulment?do you have to go to court for annulment or does the judge just approve it and sign the papers in the state of texas

    Probably your best route is to get a divorce. That will be simpler and probably quicker. He does not have to show for court but you will need an attorney.
