    Default Arresting Someone Who Is Already Serving Time

    My question involves criminal law for the state of: California & New York.

    If someone is serving time in prison and is wanted in another state after that for another crime, how would that go about? Would they take him to the state where he is to show up in court do they do it during his sentence serving or would they have to wait for him to finish is sentence and then arrest him and charge him for what he did in the other state. And if its all done during his sentence, do they like put a pause on his current sentence or would it still be going even though he will be held in another states jail or prison.

    It's my understanding that they'll fetch him after he's completed his current sentence.

    LRM is correct and I know because I used to work for the California Department of Corrections.
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.

    i wasnt questioning it i just wanted to read more on it to see if i would learn anything from it that i would not be aware of. in stead of bugging people on this board.

    In WV the direction was to check the computer (usually NCIC and the local computer) before releasing someone to see if they had a warrant in another state. If so, the procedure was to contact that state and see what they wanted to do. If it was for a traffic ticket or a bench warrant for a nonviolent misdemeanor or infraction then they were usually notified and released. If it was for a Felony they would be released and re-arrested and held for an extradition hearing (unless they waived extradition).

    I never had to deal with that, but the shift sergeants had to deal with it.
