Default Paternity Rights Where The Child's Mother Is Married
I had a long term relationship with a women who now has a child 16 months old. I have recently discovered (from her) there is a good possiblity that this child is mine. She is married but separated and was married at the time of conception.

I would like to know my rights. The women wants nothing from me. But I am considering seeking joint custody.

What are my rights and are there limitations with respect to time?

What are the Husbands rights in this situation. We all live in California

Default Paternity & Child of Married Woman
California law is more liberal with respect to paternity actions brought in relation to children born in wedlock than most states, but still appears to require: 1. That the spouses be estranged from each other at the time of conception; and 2. That the biological father have a subsequent relationship with the child.

Given that these matters can be tricky, particularly if the mother's spouse is identified on the birth certificate as the father, it is a good idea to work with a lawyer if you wish to bring a paternity action.
