My question involves real estate located in the State of: Texas
A tree fell over during a storm. Tree is on property line. Neighbors fence goes in towards their property 1 1/2 feet or so. Tree roots brought fence up. And a smaller tree is pushed against fence, sandwiched between the fence and bigger tipped over tree. The big tree with the roots that came up did not fall all the way to the ground it is being held up by other trees around it. My insurance company says if the big tree was "on" the fence it would be the neighbors responsibility. He also said it would be their responsibility for the fence and smaller tree that is on the fence. That I would have to pay for the larger tree to be removed. The roots did cause damage, fence lifted up 2 feet or so. Insurance guy says my insurance does not cover the tree. I have to pay for the removal. Not sure of this situation at all. I don't want to be taken advantage of. Just want what's fair. Also, please note we have dogs neighbors do not and they said that they just might take fence down and not put one back up so that they don't have to file a claim. Please help!!
