Default Unlawful Issuance Of Bank Checks
My question involves criminal law for the state of: UIBC (Unlawfully Issuance of Bank Checks)

My friend is being trialed for UIBC (class C felony) - one charge.

His public defender made a deal with the Prosecutor and the deal is 40 days in jail with payback of $18,000 to the bank.

Now how much time do you think the judge will REALLY give to my friend? Or do you think the judge will not put my friend in jail?

This is his 1st time

I think that if he's agreed to a deal, he'll get the 40 days in the pokey that has been agreed to.

He has a lawyer, he ought to be talking to his lawyer about that.

his lawyer says that it's up to the Judge. The Judge may declare no jail time for him.

i don't know why probation wasn't part of the deal. the public defender says it's best plea deal he could have gotten out of the DA.

it's 1st time offense. and class C felony. weird???

maybe b.c of the amt.If he can somehow gather the cash up,its best to get a good local lawyer.

I'm guessing it was because of the amount and the fact that it was from a financial institution. He could be looking at half the time maybe.
