Default Establishing paternity from overseas
Hello,
I'm Spanish and I'm living in Spain, my ex-girlfriend is Mexican and is living in California and she's pregnant.
I wanted to live in California to take care of my child but it seems she has cutted all the communications with me.
How can I do to have the hope to know my future child?? And how can I do to declare him when he will born? I don't know when he will born and I even haven't got a postal address...

Default Establishing Paternity
You can commence a paternity action to establish your rights. You should consult a lawyer now, such that you are able to get papers filed quickly after the birth of the child. If paternity is denied, the paternity proceedings will require a DNA test, now ordinarily performed on the basis of a cheek swab, to establish paternity. You may have to travel to California to participate in court proceedings.

I still have have some interrogations in my mind...
1/ I'd like to know after having established paternity what sort of rights I'll have on my child (custody, number of days I can be with him by year, where I can be authorized to meet him, last name...).

2/And if I don't know the date of the birth and where he will live, what will happen?

That's determined on a case-by-case basis.

If you can't find the mother, or don't know her present address, you should discuss strategies with your lawyer about how to effect proper service.
