Default Buyer vs Cosigner Auto Rights
My question involves an auto loan I signed for with my then boyfriend, now husband. He had bad credit so I signed for the car and he cosigned. He physically assaulted me and was arrested. I obtained a restraining order. When he was released from custody he came with a police officer to get some personal belongings. After he left I noticed the car was also gone. The plates are registered in his name so I could not report a theft. I do not know exactly where he is(have an idea). I've filed for divorce. He's made one late payment and is late on the current payment. What can I do to prevent him from defaulting on the loan and/or skipping town with the car? what rights do I have to the car?

is your name on the title?

If not, the only thing you can do to prevent late payments is pay them if he fails to do so. You can then sue him for the money but you have no right to possess the car.

If your name is on the title as an equal, you have the same rights to possess the car as he does.
