    Default What Legal Rights Does A Father Have When DNA Disproves Paternity

    My question involves paternity law for the State of: ARKANSAS. I have a friend who has been raising a two year old as his own. He believed she was his, he is on the birth certificate and signed an acknowledgement of paternity at the time of the birth. They were married and are currently seeking divorce. Conclusions of a recent DNA test state he is not the father. The child's mother wants him out of the child's life despite him being a good father and in the child's life since she was born. What are his legal rights???

    I can't find a clear statement of his rights under Arkansas law, but one way or another he should consult a lawyer ASAP.

    Typically, where the child is born during the marriage and the husband wishes to continue to be the child's father, he may do so even in the face of a DNA test showing nonpaternity and the wife's wish to exclude him from their child's life.
