    Default Landlord Is Not Following Proper Eviction Procedure In California

    My question involves an eviction in the state of:caMY BROTHER WAS LIVING IN A TRAILER AS A CARETAKER IN EXCHANGE FOR RENT. HE WENT HOME ONE DAY TO FIND AN EVICTION
    NOTICE ON HIS DOOR (30 DAY) THE REASON WAS SHE HAD FOUND A
    SHOTGUN BARRELL AND SOME AMMO IN IT, HE LEFT IT UNLOCKED FOR HER TO TAKE A CONTRACTOR IN, SO HE HAS 30 DAYS WHICH IA ALL GOOD EXCEPT THE LUNATIC DECIDED TO CALL HIS PROBATION OFFICER ON HIM.
    SO 2 DAYS AFTER THE NOTICE HE GOES TO JAIL. I HAD A KEY TO HIS PLACE AND HE ASKED ME TO PLEASE GET HIS STUFF. I TRIED AND WAS TOLD TO LEAVE AND I DID. I CALLED THE SHERIFF AND EXPLAINED AND THEY SAID I COULD GO GET THE STUFF, THIS TIME THE LOCKS ARE CHANGED AND SIGNS ARE POSTED EVERYWHERE. I HAVE LETTERS FROM MY BROTHER GIVING ME PERMISSION TO GET HIS THINGS. HE HAS THOUSANDS OF DOLLARS IN TOOLS, AND MANY FAMILY HEIRLOOMS. SHE SAYS HE ABANDONED THE STUFF. ONLY BY FORCE AND SHE KNEW EXACTLY WHAT SHE WAS DOING AND FIGURES SHE CAN MAKE SOME MONEY BY SELLING HIS STUFF. THERE IS NOT A RATIONAL BONE IN THIS WOMANS BODY. SHE IS ACCUSING HIM OF STEALING FROM HER AND TOLD THE NEIGHBORS THAT HE STOLE FROM THEM , AND THEY SET HER STRAIGHT. THE NOTICE SHE LEFT WAS NEVER FILED WITH THE COURT NOR HAS SHE FILED AN ABANDONMENT, YET SHE IS TAKING HIS THINGS
    AND TELLING PEOPLE THAT SHE IS KEEPING THEM. WHEN IF EVER CAN A LANDLORD KEEP PERSONAL BELONGINGS? HE WILL BE GONE FOR A YEAR AND SHE IS STILL TRYING TO DIG UP THINGS TO GET HIM ON. SHES BEEN MAD AT HIM EVER SINCE HE TOLD HER HE WOULD REPORT HER TO THE HEALTH DEPT FOR THE MOLD IN THE BATHROOM AND KITCHEN. I COULD GO ON AND ON ABOUT THIS LUNATIC LADY BUT I THINK I HAVE COVERED TH IMPORTANT STUFF.

    First, she doesn't have to go to court to give him written notice to vacate.

    The 30 day notice could be legal if he was renting for less than a year. She would have to give 60 days if he was renting longer than a year.

    She cannot keep his possessions. I would contact the sheriff again and see if they are willing to go with you to retrieve his belongings. Another suggestion would be to have a lawyer write the landlord a letter for the return of the property. If that doesn't work, then it will be a civil matter where your brother would have to sue her.
