Default Traffic Accidents/Liability In Person To Person Rented Car

My question involves a traffic accident in the State of: Louisiana

I have downloaded a person to person auto loan/rental agreement. It lists the lessee as the responsible party in the event that the truck should get damaged or destroyed. She is getting full coverage insurance on the vehicle and I have liability insurance on the vehicle (as the truck is paid off and LA does not require anything in addition). My concern is this,

    a. If she gets into an accident, will her insurance be liable or mine?

    b. If she gets into an accident and the other party involved decides to file suit, who is liable for any costs that are not covered by insurance?

insurance companies are not liable for anything other than what they are contracted to their clients for.

    a. If she gets into an accident, will her insurance be liable or mine?
per your contract, SHE will be liable. If her insurance is contracted to pay for her debts for however the situation happens, they will pay. If they don;t, she will still be liable.

    b. If she gets into an accident and the other party involved decides to file suit, who is liable for any costs that are not covered by insurance?
chances are the both of you would get sued and the courts would decide but unless you knew she shouldn't have been driving or there was something within your control that was contributory to the accident, she should be held responsible for any additional.
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

Have her add you as an additional insured. If the truck is damaged they will pay her and not you unless they are notified that you actually own the vehicle and put you on the policy.
