    Default Threatening a Witness

    During a court proceeding I had a witness, my niece. She was in the hallway and while there one of the parents of another witness asked what was her relation to me. My niece responsed who she was at which the woman responded that "we gonna come to your house and beat your ass". This caused an argument in the hallway and my niece was asked to go outside and she would be gotten when she was called. Well when she went outside a young man (the ladies boyfriend) followed her and approached her threatening her and cursing her out at which my niece walked away to get away from him. When she was called to testify she could not be found. My attorney advised me that her testimony wasn't really necessary so he skipped her. At the end of the trial after the judge found me guilty. He asked if anyone had anything to say. My niece stood and informed the court of what had happened to her and how she was threatened by the witness's mother and boyfriend and why she wasn't able to be found to testify. The judge said that that had nothing to do with the case and dismissed her statement.

    Threatening a witness is a felony5.

    The original case was heard in Mar04 how long do I have to file a charge against the mother and her boyfriend. If I can.

    Default Police Report

    You (or your niece) can report the incident to the police. They may be skeptical given how long it took before you acted, but if your niece did describe the incident on the record you can present the transcript to show that this is not something you just made up. (If you want a copy, you may have to order and pay for that transcript excerpt.)
