My ex and I purchased a 2006 H3 in 2005. We have since then split up 2 years ago. He is now hiding the truck and not making payments. He also has 2 DUI's that I know of and cannot even drive the truck. He has the both sets of keys. Being an equal owner do I have the right to find the truck and take it from him so that I can bring the truck back to a good status??
Ex-boyfriend, or ex-husband? If ex-husband, check your divorce judgment to determine your respective rights. If ex-boyfriend, if you have equal ownership rights you can both claim possession; but that doesn't mean that your right is superior to his.
He is my ex-boyfriend so it was a mutual agreement but now because of his court and lawyer fees he claims that's the reason he's not paying it. I told him I would take it back but he won't tell me where it is.
So even if his license is suspended he still has the right to keep it from me?? Would I be able to see if the local police would go with me to pick it up since he can't drive it anyway?? I'm just confused I guess....my main question is if he is not allowed to drive it can I take it since my license is not suspended?? It doesn't seem fair that if we both have equal rights to the truck why he should be able to hide it when he can't even drive it. Our lender and I have even been keeping each other updated on where the truck might be. Last I knew they think it's in his girlfriend's mother's garage. Since she supposedly has my truck couldn't I go there and get it from her??
