Wink Car Repo - Trying To Collect Almost 7 Years Later
I was paying on a car back in august 2001,I owed 2800.00 when they got it.(this is a side dealership)From my understanding whatever balance they didnt get from it at an auction I was responsible for.Well about 1 month later I get a letter stating they sold it at an auction and I still owed them 2300.00 cause they sold it if less then the balance. Well I didnt respond and about 1 month after that I seen the car in there car lot for sale.I had a friend stop and ask how much and they tried to offer it for 6,000.00.So obviously they lied, I dont have that letter and up until 2 months ago (6.5 yrs later) their collection agency calls wanting payment.I dont think I should pay because they are trying to rip me off and the only reason the are contacting me now is because its almost at the 7 yr mark when they cant prosecute.I need to know what I should do? I keep putting them off in hopes to make it til August But I really need to tell them something to make them think i dont know about the 7 yr thing and they are going to recieve payment.What is the best stratagy to by that time?

They may have purchased the car back at auction. As long as the auction is properly conducted, they can buy it then resell it for whatever they like.

Your rights depend upon your state, which is why you were instructed (three times) when you posted to identify your state. After this much time, your best chance would likely be claiming the statute of limitations under the laws of your undisclosed state, although in some states the debt will still be collectible - most if they previously obtained a judgment.

It seems per OP's other thread they are from Tn. - SOL has apparently elapsed. However, if they got a default judgment against you, a judgment is good in Tn. for 10 years.
