    Default Failure To Register A Deed

    10 years ago hired attorney to record a deed. Attorney never had it recorded. Just found out 7 months ago attorney never recorded deed. Attorney admitted, in writing, after another attorney was hired. Does the Statute of Repose, in Cook County Illinois, begin from the date of discovery or from the date of the wrongful act? Would a legal malpractice suit be worth pursuing? A lot more is involved but this is the point where I am at.

    We were going to tear down our old home and build a new one. Got everything together, loan, permit, plans, rented and moved into a place to live while it was being built...because of the error we lost the loan and now fixing up the old house to move back in. It comes out so far to $40,000 paid out plus the loss of the loan.

    Well then, you're entering a territory where it makes sense to try to make a claim with the first lawyer's malpractice insurance (if he has any, and if it reaches back that far) or otherwise trying to settle your case, or talking to a legal malpractice lawyer in your state.

    That's what I thought and I have an attorney researching this too. Just wanted to throw the question out to see if anyone else has been through something lie this.

    Where is the deed?

    Has the title to the land been quieted in your name?

    Not yet. That is being worked on. It is in the name of a busniess that dissolved 10 years ago.
