    Unhappy Reckless Driving Summons

    First of all, I am a U.S. Soldier. almost 2 years ago I was involved in an accident on I-64 near Ft. Eustis, VA. The police officer at the scene told me that based on everything she saw, it was a No-fault accident and did not issue me a citation. Well, I was on temporary assignment at Ft. Eustis. After I returned to my home station in KY, she contacted me by phone (the number I gave her for my contact info) and said that she had to issue me a summon (for reckless driving) to go to court because she found me at fault in the accident. I have never signed anything or recieved anything to this date. She will not forward the summon to KY or work with me in any way. Going to VA has been out of the question to date because I have been on deployment much of the time. Is this "summon" still active at this point in time? It has been almost two years and I have not heard anything else from her. My wife contacted her about 5-6 months ago and she said that nothing would be done, but I don't trust her (the officer) at all.

    If you have not received the summons, then you are not guilty of failing to appear in court. However, if it was sent to whatever address was given at the scene of the collision, then it might still be good and you might have a warrant waiting for you somewhere.

    You might consider looking into whatever legal services are available to you at your current post to see if they can help you sort this out.

    The fact that no cite was issued at the scene does not mean that a cite cannot be issued later. Frequently, that's how it works here. Someone likely reviewed the collision and told the investigating officer that a cite/summons had to be issued for the collision.

    It should not be too hard to deal with.

    If a summonw was issued it should have shown up by now on your driving record. Check there first and then you can check with the clerk of the court where the accident happened to see if they have anything. Some VA courts have an online lookup feature.
