Stopping Identity Theft
I need some help. For several years a man has been using my husbands identification in 3 states. We have never been able to proscute him due to no help from the poice and the district attorney. On 03-27-08, I found out through an internet search that the guy is locked up in a Georgia prison under my husbands name and now I am being told that the statues of limitations has run out. I know this is not exactly slander but I need help.
We live in Arkansas and crimes have been committed in South Carolina, Georgia and Tennessee. My husband has a CDL and they are threatening to take it away, plus he could lose his right to vote and purchase guns.

The person is incarcerated in Georgia, and is still using your husband's name and ID in association with that incarceration? Have you contacted the legal authorities in Georgia to start getting that corrected? They will want to establish an inmate's true identity.

Been on phone since 8 am this morning and the doc doesn't want to talk, but they are checking with the legal staff to see what damage has been done. I have also talked to the FBI, since all of this is now on NCIC report. He is in under husbands name and has been since 04/2006 will get out in 09/2008.

The statue of limitations has not run out if he is using your husbands name currently while incarcerated. Keep on the FBI.

Have you filed any reports/complaints with the F.T.C. ID Theft Division or the Social Security Administration Office of Special Investigations?
I highly recommend contacting the S.S.A. agents. Being that this guy has not only been using a stolen identity, but is currently incarcerated under it, he stands a very good chance of being Federally charged. Provided you can get the 'right people' interested.

Since original crimes date back to 1994 and 1995. I was told the sol has run out, even though he did not start serving time until 2006.

I tried FTC since credit was not damaged no go. He is using husbands ss and dob, but he mixes the numbers up. Tried to get an NCIC done on husband but since 9/11 if the person is not in custody no NCIC can be run and since husband is "supposedly" in prison no reason to run NCIC. Everything keep getting stupid and crazy by the minute.

No, if he is in custody now, using your husbands name and SSN, this is current. The sol to the crimes in 94 and 95 may have run out, but not for using his name now while in custody.

Exactly! If he's in the "big house" under your husband's ID then the offense continues...no initialized S.O.L. until the end, or last, occurrence.
