Default Summons And Complaint
I received a summons/complaint from the sheriff yesterday. I have 21 days to answer. It is for credit card debt from an assignee of CHase Bank. How do I answer? Also, the card is in my name only, can they garnish my husbands wages, or our bank account if there is a judgement? I live in the state of Michigan. I was laid off in January, and have no other source of income. I have been searching for employment since January to no avail. They also have my name wrong on the summons. I know I owe the money, when I go to court will I be able to make payments, how do they determine the amount, and if I were to get a job, how do they determine the amount to be garnished? We almost lost out home last fall due to foreclosure, and our mortgage company just had to step in and pay back taxes because we were facing foreclosure for those as well. There is no date for court, I assume I will find this out when I answer? Thank you. I am so scared.

Fill in the form truthfully. Explain that you're unemployed and unable to pay the balance.

They cannot garnish your husband's wages for your debt, but they may be able to garnish your joint bank account.

You may be able to work out payments. That will be decided in court.

Hang in there.

Thank you "LawResearcherMissy", I really appreciate the response and information. I think I will take my name off of our joint account asap. I'm feeling a little better about this whole thing.
