Default Being Sued In Texas
We received a summons stating "you are being sued" by Citibank. They want a response from us in 20 days. We have about 25K in credit card debt and turned it all over to Freedom Debt Relief in August 2007. The reason we got into trouble was because our daughter got Leukemia and we used the credit cards to pay for things when we had to take off from work once all the PTO ran out. The debt relief company has settled 2 other cards already.

Wondering why we are getting sued when we turned this over to the agency - and what are the options?

What can they get in the state of Texas if you get a judgement against you?

Why won't they deal with the debt relief company?

Do we need a lawyer?

What do we need to bring to court?

We have a mortgage on our house - 2 years in - so no equity.
We don't own our cars - make those monthly payments.
We pay our student loans - are pretty taxed out.

Any suggestions would be greatly appreciated.

Creditors don't have to work with "credit counseling" services. If you're delinquent, they can try to collect what you owe.

You know better than we do if you need a lawyer. Are you comfortable answering the complaint? Appearing in court? Presenting your defense on your own?

It may be time to consult a bankruptcy lawyer.
