    Default Aesthetic Easement

    I live in Oregon. I purchased a home on 2.06 ac. I had purchased the property prior to the home being built. At closing the realestate agent informed me that there was a 50' easment of trees that the neighbor had written up for "esthetic purposes" after occupying the property we had the trees inspected and found that they are either dead or dying and there are chances that they may fall with a good enough wind. These trees are looming directly over my home, if they fall they will fall on top of my home. I have left numerous messages at my neighbor's home with no response regarding the trees. My next action would be to try to have the easement removed. Would this be impossible or do I stand a good chance at having it lifted?

    First, make sure that your homeowner's insurance is up to date.

    Second, get a local attorney to read the easement agreement and advise you as to your rights and options.
