Smile Do I Make A Motion?
I previously managed to vacate a judgement based on a motion to quash for bad service. Now the credit card company is having difficulty providing the proof that it is my account. The judge gave us a date. At this point should I file a motion to dismiss based upon no evidence? The judge has to have a formal request, or motion, to dismiss right? He won't just dismiss.

All of this is in Illinois. Any comments you can provide are appreciated.
