    Default What would happen?

First off I have to say I dont expect alot of sympathy for my brother in law here, I would however really appreciate some honest answers.

My BIL has twin sons that are now over 18, He did pay child support for a few years but has not seen them in over 12 years and has not paid child support either. He has also been working 'under the table' for years. He would like to get a regular job and fix all of this. The BM was collecting money from the state for a long time and he owes them money. My husband and I are trying to help him and get this stuff straightened out. If he does get a regular job what will happen?

Will the state just Garnish his wages? If so by what 50%? Or will they put him in jail for not paying for so long?

Thank you for any answers you can give me.

just further information here- the support in owed in California and he is residing in Oklahoma

    Default Resolving Child Support Arrearage

If all of the support is owed to the mother, perhaps he can negotiate a lump sum payment to resolve the arrearage. If the state also has a claim due to social services provided to the family, that complicates things.

Have there been any collection proceedings, or are you simply guessing that there will be? If you're worried about criminal nonsupport charges, he should consult a lawyer. (Which wouldn't be a bad idea in any case, given a twelve year arrearage.)

He has gotten his license taken away years ago so I am sure there is some kind of action against him and it is through the state. Just wondering if he gets a job will they only garnish his wages or put him in jail?

    Thank you

    Default Support Action

    So you're guessing?

If they know where he is to suspend his license, they know where he is to pursue him for any criminal non-support charge.

his license was suspended long ago and it was not in the state he is in now. The only thing I am wondering about is if they will garnish his wages or just put him in jail
