    Default Deportation For Having More Than One Retail Fraud Conviction

    I just found out that INS will attempt to deport any US resident who has more than 1 retail fraud - 3rd degree which are related to moral turpitude (I also was told if one of the retail frd conviction with max penalty of $500 and max 93 days in jail alone isn't enough for deportation, but because there are 2 convictions... most likely will be a serious issue for deportation).

    My relative is about to appear in court for pre-trail of the 2nd retail fraud - 3rd degree. Is there an equivalent conviction which he can ask for which avoid to be related with the moral turpitude issue for INS will spare his behind?

    Default Retail Fraud Convictions

    He can attempt to plead to a lesser shoplifting charge. He should be working through a criminal defense lawyer familiar with immigration issues, or having any proposed plea deal approved by an immigration lawyer before pleading guilty.

    It is important to know in what State your relative resides. You should consult an immigration attorney to avoid immigration consequences of the second conviction/trial. Your immigration attorney should cooperate with your criminal lawyer to get the best result.
