Did you assert your right to a DMV hearing?
You had seven days (starting from the day you were arrested).
However, I don't see how you will convince the DMV that you are not guilty of refusing to take the test.
If they find you guilty, your license will be suspended for a year. The outcome of that hearing has no bearing on the criminal case against you.
If you don't get charged with a DUI in criminal court, that will not make a difference to the DMV.
Two separate issues.
Ok, but in the state of Wisconsin with a Refusal, you are eligible for a occupational license after 60-90 days whearas in Colorado you only qualify after 1 year. So if I am charged with a refusal in CO and it is reported to WI can I return to WI and obtain a occupational license after the 60-90 day time period? It seems that I should be able to since my home state is WI.
Any input would be greatly appreciated. Thank You.
