Default Civil Complaint On Old Debt
I have an old credit card debt, that according to my credit report, the date of last activity was 7/2001. I am in Ga, so I believe the statute of limitations has expired. Today, I recieved a summons of a complaint from a company that bought the debt years ago. It has their attorney's name on it. I did a search with the Ga bar & his name was not even listed with them. Anyway, I was wondering the best way to respond to this complaint myself, or do I need to get a lawyer? I have 30 days to respond. This debt is listed with 2 credit reporting agencies, but not listed on 1 of them. On the 2 that it is listed on, it is due to fall off in 3 months. But, regardless, I believe the SOL is up. Thanks for any help you can offer.

You can respond yourself but be sure to respond in the time limit allowed. Your summons should explain how you need to respond.

Check with the court to be sure the complaint has actually been filed. Then file your reply asserting the affirmative defense of SOL.

It's still possible to sue you even if the SOL has expired but you would use the SOL has elapsed as your defense as lwpat indicated.
