    Default Downgrade And Forced To Go

    I was hired 3 months ago at a director level position, which is a newly-created position. The supervisor started to challenge everything of my work and mentioned this position should be a manager level with lower salary since he did not see I am performing at director level. then this week he and a HR person told me they decide to downgrade this position. I chose not to pursue but leave.
    Is this a legal activity? I feel it may be a discrimination since I am the only minority in the group.
    Is this eligible for unemployment insurance benefit?

    You were just as much a minority when you were hired. If they were going to discriminate against you because of your ethnicity, it would have been much easier and much harder to prove to just not hire you in the first place.

    Demoting an employee because they are a minority is illegal. Demoting an employee because their performance is unsatisfactory is entirely legal.

    Did the supervisor who complained about your work and eventually downgraded you hire you?

    Were there any complaints about the performance of the non-minorities?

    Re your question on UI - normally you don't receive UI benefits if you quit. However, there is nothing to stop you from applying. Only the UI Dept. in your state can make the decision as to whether you will receive them or not.
