Oral Lease

My roomate has the the lease in his name because I was going to study abroad Jan-April 06. I pay my half of everything by giving him a check upon request every mth. However, he has become intolerable. He does not clean up like he said he would, and has become completely negative about everything. [i am just trying to set up the situation]. I know this sounds ridiculous but I just can't live with him any longer. Oh yeah, both of us are finishing our first year of law school. I have posted ads recently to see if anyone would lease the room but no responses. Does anyone know an appropriate remedy? Thank You:

Agreement was to pay my half of the rent and utilitites.

Sorry about being unlcear. The lease runs until the end of July 06. He stated that he would pay the rent from Jan-April when I studied abroad b/c it was cheaper for him in the long run. I am not studying abroad now, but would like to get out of this apartment base on numerous factors.

From what you have said, you would owe rent for this month, December, May, June and July (perhaps mitigated if he finds a replacement roommate). If you were to lie and claim a month-to-month tenancy, and he couldn't prove a lease, you could ostensibly escape upon one month's notice; but you wouldn't want to lie, would you? :?
