Default Domestic battery charge for an accident
Okay check this out right me and my fiance and my son were staying at a shelter there was a situation that occured between us, but here is the funny part right someone at the shelter called 911 when they heard us arrguing, and the cops came my fiance proceeded to tell them what happened I mean no big deal right, but they say her holding her stomach and she is pregnant so they asked her what was wrong she proceeded to tell them that I had my back turn to here and when she called my name as I was turning around towards her and she was walking quickly towards me that she accidently bumped into my forearm with her stomach and that that was why she was holding her stomach, the cop then siad was he going to hit you she said no I bumped into him, the cop proceeded to say that I was going to hit her even as she kept telling him that she ran into my forearm, he then proceeded to put on the police report that I struck her in the stomach, now how is it that they are charging me with domestic battery if I didn't even do anything I was even surprised when they told me I_ was being charged with it I had to ask them if this was some kind of joke, my question is what can I do to get this story right and can you be charged with battery even if you didn't do it and it was by accident because I don't think that its right even when she is saying that I did not hit her plz help. What can I do osince she doesn't want to go to court and she is not going. :shock:

By shelter, do you mean a shelter for battered women?

Default "Accidental" Alleged Battery
The police are used to having people lie to them about domestic violence incidents, and apparently they don't believe you. It would benefit you to consult a criminal defense lawyer.
