    Default Liability after Quit Claim Deed

    Hi,
    I'm a married man. I recently bought a house without my wife on the loan papers (She doesn't have a Social security number). But, I wanted to add my wife to title so that she can sell the property, if something happens to me.

    The title company first made my wife sign a quit claim deed giving rights to me. Then, made me sign a sale deed giving rights to both myself and my wife. They recorded the second document (sale deed) two days later.

    Now, someone sued my wife. Can they come after my house eventhough she signed a quit claim deed Initially before I signed a sale deed. Please note that Quit claim deed says " The purpose of this quit claim document is to relinquish any possible community interest that grantor (my wife) may have or may acquire in the future."

    Default Interest in Home

    If your wife has a legal interest in the home, it could conceivably be attached to pay a judgment in a lawsuit. As you state that the conveyance of the house by you, to you and your wife, post-dates the quitclaim deed, that deed likely governs.

    Thanks very much for the response. The Quit claim says " The purpose of this quit claim document is to relinquish any possible community interest that grantor (my wife) may have or may acquire in the future."

    With this in the quitclaim, does it matter if the sale deed post dates the quitclaim deed.
