I was wondering if anyone can give me some feedback. When my son was 13 years old he got in trouble at school ( he was accused of trying to steal a cd play) well, it was not true, so when I went with him to court, at first I said not guilty, but the judge scared me when he said okay, you can have a jury trial and hire an attorney. I then changed my sons plea to no contest. Well, I felt the judges condition of this was to harsh and then hired an attorney (cost me 1300.00 dollars) and the attorney appealed the judges desision and the case was dismissed. Well here is the problem, I just found out that when you do a back round check on my son it comes up. I found out that when the attorney filed the appeal he filed it in a higher court and this appeal is on my sons record as a misdemeanor theft/or forgery of checks (case was dismissed)because it was appealed in an adult court. I now am told that I have a choice to have it expunged. I then called the attorney who handled this and he said he does not remember appealing it, but it I want an expungment it will now cost 500.00 plus 185.00 in court fees. I feel that I am being robbed legally because if I had known that this would happen, I would have just went along with the origingal ruling (although I felt was too harsh), because it would not have been on his record now and would not have cost me a cent. I am a single parent and this is alot of money. Is it possible to do an expungement on my own? Does the attorney have an obligation to resolve this issue with charging me? Or is this the was the cookie crumbles and do I just pay him and get it done with? Because no matter what I have to get this off his record.. I would appreciate a responce from anyone who is knowledgable in this area. Thank you Rosalie
