Suspended Registration For Insurance Gap

New York,
My wife was pulled over and towed because the officer said her registration was suspended. She paid the registration fee and was given new pplates. She has a court date for a misdeaminor. this was for an insurance gap that I forgot to pay(we have insurance), and did tell her. SWould it help if I go to court with her and explain she did not know. What will be her penalty?

What is the exact charge against her? (Provide the citation to the statute or ordinance.)

If you don't pay your insurance bill, such that your policy lapses, during the lapse you are uninsured. Have you now paid your bill, such that your policy is in full effect?

The exact charge is driving with suspended registration. yes we have insurance now and it was in effect when she was pulled over. There was a ten insurance gap last year and was paid the beginning of this year once I remembered.

First of all, it is not a gap in your insurance, it is called a lapse. It is an unclassified misdemeanor. If you have written proof that your insurance was in effect based upon the date on the ticket your wife will probably get out of the ticket. Next time you get something from the DMV do not ignore it.
