Quit Claim Deed Fraud

I recently discovered that my ex husband either had himself or someone else sign my name to a quit claim deed for property we owned during our marriage and had it noterized and filed with the court house. The property in question was not part of the divorce due to he was in such a rush to devorice me without my knowledge that he forgot to include it. The court house filing I have found regarding this is dated 1996. I need to know 1) is there a statue of limitations 2) Can charges be brought against him for forging my name. Any help with this would be great.

Hire a lawyer to get your interest in the land back.

It will be around $10K (if cheap) and take around three years (if quick).

Thanks for the info. Could I just take him to small claims court? I do not have that kind of money.

You did not name your state. If this happened in CA you can have charges brought against the notary if they failed to get proper ID and a thumb print. If the notary followed procedure you can get a copy of their journal and I'm sure some sort of legal authority can advise you on how to find out the true identity of the person with the fake ID based on their print in the journal.

Get a copy of the QCD and see if it was in fact notorized. Someone might have been asleep at work that day. Then yes, go after the husband and the notary.

Yes, the notary probably had a bond.

This took place in Florida. The document was found by accident while checking the cities public records for another issue. I am concerned about the time frame because it was filed in 1996, but I just recently found out about it. I do not have the funds to go through a long process, but considering trying to bring fraud charges against him and possibly taking him to civil court. Any suggestions/help would be great.
