    Lightbulb H1B Visa Re-Stamping Issue

    Current Visa Status: H1B valid till 30-Sep-2008. This is my first time, so i am expecting to get 3yrs more.

    Help on US Visa Re-Stamping.
    1. What is Cost for Visa Re-Stamping?
    2. Do i need to leave USA for Re-Stamping?
    3. Can i plan to go india after Re-Stamping? And if Yes than do i need to Re-Stamp again at local consulate before coming to USA. (Planning to go india in dec 2008.)
    4. Can i Re-Stamp before 30-Sep-2008. Can i Re-Stamp in March End (Mar-2008)
    5. How can i ensure that my employer will Re-Stamp. I have bit spoiled relation with my employer, so in this case how i can ensure that he will re-stamp my visa, do u suggest me to change employer in this case or should i stay with this employer.
    6. List of documents required for Visa Re-Stamping (Especially from employer).
    7. How much PaySlip required?
    8. What are chances of getting visa re-stamped?

    2. Visa stamping is only done in US Embassy or Counsulate outside of US. So, yes you need to travel outside of US.

    3. It would be better if you get visa stamp in India, if that is your home country.

    4. It is better to get Visa Stamp before your old visa expires, just in case you get denied, you can still travel back to US with your old visa stamp. Some Consulate Officer(CO) would not give visa stamp, if it is 6 months valid, or soe would. Nobody can know. It is totally upto CO.

    5. As long as you have Approval of your new H1B petition (or extension of another 3 year term H1B), your employer cannot interfere the visa stamp. You can only work for specified employer on your I-797C Approval Notice with H1B. If you change employer, you need to either transfer or get new H1B approval.

    6. Completed DS-156 Nonimmigrant Visa Application Form with US Passport Size Photo, DS-157 Supplemental Nonimmigrant Visa Application, The Original Approval Notice of your I-129 Petition, Copy of I-129 with supporting document, Employement
    Verification Letter or Job Offer Letter from Employer, Copy of your Resume, Degree and/or Cerfiticate verifying your ability and qualification to the employment, Most recent Pay slips.

    7. Usually 3 latest is sufficient.

    8. Nobody can predict, but if you bring all required documents and if you haven't had any trouble with US Immigration or US law in general, you will be fine.
