Default How To Dispute Paternity And Request A DNA Test In Florida

Hi my name is Christopher, I'm 20 years old. I was with my girlfriend for 2 years, she got pregnant and we decided to keep the baby. When she was 7 months into the pregnancy i found out that she had been sleeping with my friend, this happened for a period of 6 months and she was not sure who the father of the unborn child was. We decided to work out the problem and stay together. We did not have a paternity test done and i signed the birth certificate. We were not married at the time of birth, we got married 3 months after the baby was born. After 12 months of trying to work out our problems i realized that we were not suitable for each other and infidelity is hard to forgive. we are now separated, and i have no legal rights over the baby because Florida law is if the couple is not legally married then paternity has not been established... Weird huh... But if you signed the birth certificate, paternity is established but only through the revenue system "child support" but we cannot use that in a court of law...

What i would like to know is what do i have to do in order to dispute paternity, and request a DNA test through the court system??

I already tried doing it through child support and they denied my request because i signed the birth certificate and that is enough information for them to say i am the father...

all i want to do is to know if this is my daughter, and to stop the child support order, because i really don't know if the child is mine...

I am only 20 years of age, my wife is 19 with 2 kids from different fathers. I am not sure if the best way to go is to hire an attorney, and if so i don't think i have the money for this...

what can i do to resolve my problem???

Okay....

First, google "contraception".

Second, get an attorney to files a denial of paternity. You will be required to submit (and pay for) a DNA test.

however, unless the true father of the child is willing to step up to the plate you are going to have a rough road.

States like a child to have a father.

I was with this woman 7 years ago and we lived togeather for about 6 months.We had lots of unprotected sex of course or I would not be here.She was Canadian and desperate to marry for citizenship and I would not.We split on a fast and bad note and she replaced me before we even had separate places.She contacted me last year by finding me on the internet with myspace.I went to visit her to catch up and make good on a bitter taste that was left.Things were fine,she started showing me pictures of a girl her forst born and then told me she though it may be mine due to timming etc and also the fact she looks like me and not really at all like him.So shorten this she consented to take a buccal swab dna test over the internet.The test was done incorrectly and we both new it at the time.The results came back negative and now she will not concent to another dna test,tel the father etc nothing.She does not care that I need to know that this is not my child.I can not morally do that.I need to know.When the baby was conceived she and the guy were not married but may have gotten married before the child was born.he knows nothing of this and they have been separated for 2 years now.She had told me before the results came back that she always would have nighmares of talking about it in her sleep.The baby child does then and still continues to look like me from what I can see.They did have one child that was definitely thiers 2 years later and the sisters share very little in resemblance.She is in the state of Florida and already did consent to one dna test.it was not a legal one,just a cheap 89dollar one,dumb on my part.Do I have any way to have a court ordered paternity test?She will not cooperate at all,I do not want it to be like this but I can not simply act ike the probability of the child being mine to be low at all.I als remember inthat last month she had a very late and very light period.She told me the same thing happenned when her second daughter was born.I am sure she is mine what can I do?Thanks for any and all help.
