Default Legal Father Says He Is Not The Biological Father
I am from Texas. I have been divorced from my ex-husband for 13 years. We have three children. I am the custodial parent. He told me that during one of his visits with the children that he had a DNA test done on him and the youngest child (15 years). He recently called and said that the DNA results showed that he is not the biological father and wants me to sign papers agreeing to dismiss him from child support obigations. He is so in arrears with the child support that he recently was served to pay in full the arrearages since he failed to make monthly payments to the Child Support Office as directed by the Court last year. I received a call from his attorneys office yesterday requesting to meet with me to come to some kind of agreement. Not sure where to go from here. Can you give me some guidance?

After 13 years, there's no way that he will be able to get out of paying current support and arrears.
The time for him to have questioned paternity was during the divorce, not 13 years later when he owes arrears.

Don't worry, the courts are used to this type of ploy from a father who owes arrears, and it's not going to do anything for him except to make the Judge angry with him for pulling this.

My advice, do NOT accept any agreement offer from him that allows him to not pay CS and the arrears.

Hummm.... most interesting. And when the time for her to have told him that he is not the father, and that she was asking the court to order him to pay child support for some other man's child?

Haha-in my view the government,court,CSEA, etc. ,are not interested who pays,they are interested in someone to pay.
